Why should you consider a prenuptial agreement?

Jun 15, 2021 | Prenup Agreement, Attorney at Law, Prenuptial Agreement

There are many important topics couples need to discuss before entering into marriage but one of the topics no one seems to want to bring up is a prenuptial agreement.  While a prenuptial agreement is legally binding, it does not have to be scary. You definitely shouldn’t be automatically offended if a person you love asks you to sign one. There are several reasons why such an agreement may be a benefit for you too.  Alternatively, if you think you need a prenuptial agreement before you get married, then you should not shy away from asking your prospective spouse to sign one.

A prenuptial agreement protects you AND your future spouse’s finances.

Most people think of a prenuptial agreement as a wealthy person’s way of protecting their assets in case of a divorce but a prenuptial can actually protect both spouse’s assets and can protect you from paying debt incurred by a future spouse. If one spouse creates a significant amount of debt, a prenuptial agreement can protect the other spouse from being liable on that debt.

A prenuptial agreement makes plans for life in the long term.

Most couples are so focused on the wedding and their blossoming love that they forget to plan for the future. A prenuptial agreement can make clear issues like long-term care, health insurance and estate planning. It can also be used to plan for the future of a family business and how a spouse fits into the management of that business.  If you have children from a previous relationship then a prenuptial agreement may clarify a new spouse’s role in their life as well.

A prenuptial brings up important topics early on.

The topics covered in a prenuptial agreement are often the most difficult to discuss. It’s best to have these discussions early on, while the love is strong, rather than to hash them out with divorce lawyers later on.
